Disclaimer

Access to, and use of, this site is provided by The British Association of Landscape Industries subject to the following terms and conditions ("Terms"):

1          Disclaimer

1.1       golandscape.co.uk is the website ("site") of the British Association of Landscape Industries ("BALI"). BALI makes no warranties, representations or undertakings about any of the content of this site (including, without limitation, any as to the quality, accuracy, completeness or fitness for any particular purpose of such content), or any content of any other website referred to, referred by or accessed by hypertext link through this site (‘third party site’).

1.2       BALI does not endorse or approve the content of any third party site, nor will BALI have any liability in connection with any of them (including, but not limited to, liability arising out of any allegation that the content of any third party site infringes any law or the rights of any person or entity).

2          Copyright

2.1       All rights, including copyright and database right, in BALI site and its contents, are owned by or licensed to the British Association of Landscape Indutries, or otherwise used by BALI as permitted by applicable law all rights reserved.

2.2       In accessing BALI site and its contents, you agree that you will access the contents solely for your own private use but not for any commercial or public use.

2.3       Except as permitted above, you undertake not to copy, store in any medium (including in any other website), distribute, transmit, re-transmit, broadcast, modify, or show in public any part of BALI site without the prior written permission of BALI or in accordance with the Copyright, Designs and Patents Act 1988. You also undertake not to incorporate any of this site’s content into or store it in any other website, electronic retrieval system, publication or other work in any other format (whether hard copy, electronic or other) without prior permission from the British Association of Landscape Industries. In order to avoid doubt, framing of this site, or any part of it, is not permitted without express permission.

3          Viruses, Hacking and Other Offences

3.1       You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.

3.2       By breaching paragraph 3.1, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

3.3       We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.

4          General Terms

4.1       Use of this site constitutes your acceptance of these Terms, which take effect immediately on your first use of the site. BALI reserves the right to change these Terms at any time by posting changes online.  

4.2       You are responsible for reviewing regularly information posted online to obtain timely notice of such changes. Your continued use of this site after changes are posted constitutes your acceptance of the Terms as modified by the posted changes.  

4.3       Material may not be copied, reproduced, republished, downloaded, posted, broadcast or transmitted in any way except for your own personal non-commercial use. Any other use requires the prior written permission of the British Association of Landscape Industries. You agree not to adapt, alter or create a derivative work from any of the material contained in this site or use it for any other purpose other than for your personal non-commercial use. You agree to use this site only for lawful purposes, and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of this site by any third party. Such restriction or inhibition includes, without limitation, conduct which is unlawful, or which may harass or cause distress or inconvenience to any person and the transmission of obscene or offensive content or disruption of normal flow of dialogue within this site.  

4.4       You should always take appropriate advice where you intend to act on any information on this site as to whether such action is suitable in your individual circumstances.  You should always take appropriate safeguards against virus protection before downloading information from this site or any third party.

4.5       This site and the information, names, images, pictures, logos and icons regarding or relating to the British Association of Landscape Industries, its products and services (or to third party products and services), is provided "AS IS" and on an "AS AVAILABLE" basis and to the maximum extent permitted by law without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

4.6       In no event will BALI be liable for any damages including, without limitation, indirect or consequential damages, or any damages whatsoever arising from use or loss of use, data, or profits, whether in action of contract, negligence or other tortious action, arising out of or in connection with the use of the site. BALI does not warrant that the functions contained in the material contained in this site will be uninterrupted or error free, that defects will be corrected, or that this site or the server that makes it available or any third party site are free of viruses or bugs or represents the full functionality, accuracy, and reliability of the materials. The names, images and logos identifying BALI or third parties and their products and services are proprietary marks of BALI and/or third parties. Nothing contained herein shall be construed as conferring by implication or otherwise any licence or right under any trademark or patent of the British Association of Landscape Indutries, or any other third party. 

4.7       If any of these Terms should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these Terms are intended to be effective, then to the extent and within the jurisdiction which that Term or Condition is illegal, invalid or unenforceable, it shall be severed and deleted from the Terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.  

4.8       Any reference in these Terms to any statute shall be construed as reference to that statute as amended, re-enacted or extended at the relevant time.

4.9       This site is designed to be used by persons resident in the United Kingdom.  These Terms shall be governed by and construed in accordance with the laws of England and Wales. Disputes arising here from shall be exclusively subject to the jurisdiction of the courts of England and Wales.  

4.10     If these Terms are not accepted in full, you do not have permission to access the contents of this site and therefore should cease using this site immediately. 

Privacy Policy

GoLandscape respects your privacy and is committed to protecting it. We provide this Privacy Statement to inform you of our Privacy Policy and practices and of the choices you can make about the way your information is collected online and how that information is used. This website is governed in accordance with the laws of England. The English courts shall have exclusive jurisdiction over any dispute arising out of your use of this website.

ga.js – Cookie Usage

The ga.js JavaScript library uses first-party cookies to:

  • Determine which domain to measure
  • Distinguish unique users
  • Remember the number and time of previous visits
  • Remember traffic source information
  • Determine the start and end of a session
  • Remember the value of visitor-level custom variables
  • By default, this library sets cookies on the domain specified in the document.host browser property and sets the cookie path to the root level (/).

This library sets the following cookies:

__utma 2 years from set/update Used to distinguish users and sessions. The cookie is created when the javascript library executes and no existing __utma cookies exists. The cookie is updated every time data is         sent to Google Analytics.
__utmb 30 mins from set/update Used to determine new sessions/visits. The cookie is created when the javascript library executes and no existing __utmb cookies exists. The cookie is updated every time data is sent to Google Analytics.
__utmc End of browser session Not used in ga.js. Set for interoperability with urchin.js. Historically, this cookie operated in conjunction with the __utmb cookie to determine whether the user was in a new session/visit.
__utmz 6 months from set/update Stores the traffic source or campaign that explains how the user reached your site. The cookie is created when the javascript library executes and is updated every time data is sent to Google Analytics.
__utmv 2 years from set/update Used to store visitor-level custom variable data. This cookie is created when a developer uses the  _setCustomVar method with a visitor level custom variable. This cookie was also used for the deprecated _setVar method. The cookie is updated every time data is sent to Google Analytics.

Data Collection

If you choose to register with GoLandscape then we are required to collect more information from you. This information is detailed on the registration application forms. This data is stored on a database on a secure server. It is up to the user to inform GoLandscape of any changes to this data.

If we require sensitive personal data then we will ensure that the collection and use is in strict accordance with the UK Data Protection Act 1998 and EC Directive on Data Protection 95/46/EC principles of data protection and data privacy. We may appoint third party organisations to assist us in providing you with the information, goods, products and services you request. In these circumstances, we will take steps to ensure that your personal information is held in strict accordance with our privacy policy and is only used for the purpose of fulfilling your request. We also reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our Web site.

Except as set out above, we will not pass your details to anyone else outside GoLandscape without your permission. If we look to use your personal data for a new purpose, beyond what it was originally provided for, we will ask for your consent.

If you request it we will provide you with a readable copy of the personal data that we keep about you, within 30 days; we will require proof of your identity. We allow you to challenge the data that we hold about you, where appropriate, you may have the data: erased, rectified, amended or completed. We reserve the right to refuse to provide our visitors with a copy of their personal data, but will give reasons for our refusal. You will be able to challenge our decision to refuse to provide you with a copy of your personal data.

We have implemented security policies, rules and technical measures to protect the personal data that we have under our control that complies fully with data privacy & protection legislation appropriate to the jurisdiction applicable to the site.
